The petitioner has preferred this application for grant of regular bail in a case registered under sections 363 and 366A of the Indian Penal Code and section 8 of the POCSO Act. As per the prosecution case, the three accused persons including the petitioner herein are said to have kidnapped the minor daughter of the informant. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The daughter of the informant returned and her statement was recorded under section 164 Cr.P.C. From perusal of the same, it would transpire that the petitioner had no reason to be involved in the commission of kidnapping. It was Umashankar Yadav
Patna High Court CR. MISC. No.50675 of 2021(2) dt.24-02-2022 2/2 who wanted to marry the daughter of the informant. The petitioner has been falsely implicate in the case for the reason of his being on friendly terms with the said Umashankar Yadav. It is further submitted that the petitioner is in custody since 21.6.2021. Chargesheet has been submitted in the case. Heard learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the facts of the case, the daughter of the informant having returned and having stated that the accused persons did not misbehave with her, the petitioner being in custody for 8 months and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Madhepura (Dhailad) P.S. Case no.612 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (POCSO), Madhepura.
