JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-07-2017 The petitioners seek bail in connection with G.R.P.S. Kuil P.S. Case No. 76 of 2017 registered for offences punishable under sections 30(a), 38(i) of the Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioners is that there were recovery of 28 litres of country made liquor from petitioner no.1, 36 litres from petitioner No. 2 and 10 litres from petitioner No. 3. Submission of learned counsel for the petitioners is that they have clean antecedent. It has further been stated that the petitioners are in custody since 10.04.2017.

Having heard both sides and considering the

Patna High Court Cr.Misc. No.33836 of 2017 (2) dt.21-07-2017 aforementioned facts and circumstances, this application is allowed. The petitioners are directed to be released on bail on furnishing bail bond of Rs. 25,000/- each with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge-II-cum-Special Judge, Excise, Lakhisarai, in connection with GRPS Kuil P.S. Case No. 76 of 2017, subject to the following conditions:- (i) One of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the Court and in the event of failure on his part to appear before the Court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
