JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-09-2018 The petitioners are apprehending their arrest in connection with Chausa P.S. Case No. 61 of 2018, registered for offences punishable under Sections 302, 201, 120(B)/34 of the Indian Penal Code.

Petitioner no.1 is the father-in-law of the deceased and petitioner no.2 is the sautan of deceased and the allegation against them is that they have killed the deceased and kept the dead body in a large box.

Submission of learned counsel for the petitioners is that petitioner no.1 is father-in-law and he is living separately. Moreover, he aged about 60 years and the allegation is general and omnibus in nature and so far petitioner no. 2 is concerned, no specific allegation has been attributed to her.

Patna High Court Cr.Misc. No.45351 of 2018 (4) dt.10-09-2018 2/2 Heard learned A.P.P. also.

Having heard both sides, in view of the above facts as well as in view of the heinous nature of the allegation, I am not inclined to grant privilege of anticipatory bail to the petitioners rather they should be surrender before the court below and make prayer for regular bail, which would be considered on its own merit.

Accordingly, this application is dismissed.
