This application has been filed in connection with S.Tr. No.377 of 2016 arising out of Dinara P.S.Case No.14 of 2016 for the offence under Sections 304(B), 201/34 of the Indian Penal Code.

It is submitted on behalf of the petitioners that they are father-in-law and mother-in-law of the deceased and no specific overt act has been alleged against them. The F.I.R. shows that the information had been sent on 14.01.2016 in spite of that F.I.R. has been lodged on 16.01.2016 and the petitioners are in custody since 08.09.2016.

Having heard both sides and in view of the fact that no

No.5639 of 2017 (3) dt.20-03-2017 2/2 specific allegation has been alleged against the petitioners and they are father-in-law and mother-in-law of the deceased and they are in custody for about six months, let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned 8th Addl. Sessions Judge, Rohtas at Sasaram in connection with S. Tr. No.377 of 2016, arising out of Dinara P.S.Case No.14 of 2016 dated 16.01.2016. With following conditions :

(i) One of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.

(ii) The petitioners will not induce any witness or tamper with the evidence.

(iii) The petitioners shall co-operate in the disposal of trial and make themselves available as and when required by the court and on the event of failure on their part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of their bail.
