The petitioner prays for bail 0in Gaya Muffasil P.S. Case No. 352 of 2016 registered under sections 420 & and 474/34 IPC. On an information, the police are said to have made a search on the house of one Deepak Singh wherefrom recovery of the ATM/Debit cards, passbooks and one LCD were made. On a disclosure made by the co-accused Deepak Singh, the house of the petitioner was searched from where few ATM cards, credit cards of different banks, passbook etc. were recovered. The contention of the petitioner is that out of several recovered ATM cards & passbooks, six of them belonged to the petitioner and his family members. Referring to annexure-2 of the

Patna High Court Cr.Misc. No.47628 of 2016 (4) dt.05-12-2016 2/2 supplementary affidavit, it is submitted that the co-accused Deepak Singh has been released on bail by the court below. The petitioner is in custody since 05.08.2016 having no criminal antecedents.

Considering the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of CJM, Gaya in Gaya Muffasil P.S. Case No. 352 of 2016 on condition that one of the bailors of the petitioner shall be his own/close family member. In the event of framing of charge, the petitioner shall appear in person each date fixed at the trial. In case of default in doing so on two consecutive dates, the trial court shall have liberty to cancel his bail bonds and secure his arrest in accordance with law. Furthermore, if the petitioner involves himself in similar offence during the currency/subsistence of the privilege of bail, the same shall be construed as a breach of condition of bail entailing cancellation of the same.
