2. The petitioner has preferred this application for grant of regular bail in connection with Warisaliganj P.S. Case No. 17 of 2025 dated 09.01.2025 registered for the offences punishable under Section 126(2), 109(1) read with Section 3(5) of B.N.S.

3. As per the prosecution case, when the informant was returning his home after attending the natures call, in the meantime, the petitioner and the co-accused persons stopped and started abusing him. It is further alleged that the petitioner assaulted on the neck of the informant with hasuli due to which blood started oozing out and the co-accused persons Shailendra

No.39405 of 2025(2) dt.08-07-2025 2/3 Chaudhary and Atul Chaudhary @ Mohan Chaudhary assaulted with rod on the head of the informant with the intention to kill and the other co-accused persons started pelting stones and bricks on the informant, as a result of which he lost consciousness and fell on the ground.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. The charge-sheet has been submitted against the petitioner. As per the injury report annexed as Annexure-3, the injured sustained cut injury on his neck which is simple in nature. The petitioner has no concern with the alleged occurrence. The petitioner has two criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 09.01.2025.

5. Learned A.P.P. for the State has opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court
