ANJANA MISHRA ORAL ORDER 29-10-2015 Heard learned counsel for the petitioner and the learned counsel for Opposite Party No.2 as well as the learned counsel appearing on behalf of the State.

The petitioner is apprehending his arrest in connection with Trial No.4079/13 arising out of Complaint Case No.2412 of 2012 for allegedly having committed the offence under Sections 406 and 420 of the Indian Penal Code and Section 138 of the N.I. Act.

Learned counsel for Opposite Party No.2 submits that as per the earlier directions, the money, which was due to the Opposite Party No.2, has been paid to him in cash and as such,

Patna High Court Cr.Misc. No.44169 of 2014 (8) dt.29-10-2015 2/2 there is no further dispute.

Considering the aforementioned facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari, in connection with Trial No.4079/13 arising out of Complaint Case No.2412 of 2012, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
