Petitioner seeks regular bail in connection with Excise Case No.310 of 2017, arising out of Barbigha P.S. Case No.112 of 2017 registered for the alleged offences under Sections 420, 414, 409, 467, 468, 471, 272, 273 and 188 of the Indian Penal Code and Section 30 of the Bihar Excise and Prohibition Act, 2016.

As per the prosecution case, the petitioner along with six other persons are said to have been vending the liquor and after seeing the police force managed to escape from the spot. The Police seized 60 liters of wine from the field. It has been submitted by learned counsel for the petitioner that the petitioner is an innocent and has committed no

Patna High Court Cr.Misc. No.29528 of 2017 (02) dt.01-07-2017 2/2 offence. He has been falsely implicated in this case. There is no recovery from the conscious physical possession of the petitioner. There is no specific allegations against the petitioner rather the allegations are general and omnibus in nature. He has been languishing in jail custody since 16.05.2017. In the facts and circumstances of the case, the petitioner above named is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned 1st Additional District and Sessions Judge, Sheikhpura in connection with Barbigha P.S. Case No.112 of 2017.
