Petitioner is languishing in custody since 27.07.2016 in connection with Bounsi P.S. Case No. 157 of 2015 for offences punishable under Sections 366, 364/34 of the Indian Penal Code and later on 302/201 of the IPC was added.
Babli Devi who is widow sister of the informant was found missing from her house since 08.12.2015. The FIR was lodged on 26.12.2015 and thereafter deadbody of Babli Devi was recovered on 30.12.2015. The petitioner and others were suspected to have abducted Babli Devi in the FIR. After seven months of the occurrence some witnesses stated that the petitioner was last seen with Babli Devi on the date of occurrence. That much is the material against the petitioner in the case diary. There is no case of strong motive against the petitioner to commit her abduction or

Considering the aforesaid, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge III-cum-Additional Chief Judicial Magistrate III, Banka /Successor Court, in connection with Bounsi P.S. Case No. 157 of 2015.
