2. The petitioner apprehends arrest in connection with Bounsi PS. Case No. 92 of 2021 dated 18-08-2021, instituted under Sections 341,323, 308, 354B and 504/34 of the Indian Penal Code.

3.As per the prosecution case, the allegation against the petitioner is that he assaulted the informant on the head and left hand with a sharp-edged weapon causing injuries.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in the present case. It is further submitted that although there is a

No.39224 of 2025(4) dt.16-10-2025 2/3 specific allegation against the petitioner of having inflicted injuries on the informant's head and left hand with a sharpedged weapon, the injury report does not corroborate this allegation. There is a complete absence of any mention of injuries caused by a sharp weapon and the nature of the injuries has been mentioned as simple. It is next submitted that both parties are next-door neighbours and are agnates. There is a case and counter-case between the parties. The counter-case was lodged by Roushan Ara, being Bounsi P.S. Case No. 93 of 2021, under Sections 341, 323, 354B, 379, and 504/34 of the Indian Penal Code. Lastly, it is submitted that the petitioner has no criminal antecedents.

5. Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge- II, Araria, in Bounsi PS. Case No. 92 of 2021 corresponding to ST. No. 695 of 2024, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik
