Petitioner prays for bail in connection with Nautan P.S.Case No. 231 of 2018 registered for the offences punishable under Section 12 of POCSO Act.

Allegation against the petitioner is of having obscene talk with the daughter of the informant.

Submission of learned counsel for the petitioner is that no offence under Section 12 of POCSO Act is made out against the petitioner and moreover falsity of the case will appear from the fact that the case was drafted by a deed writer and prior to that there was land dispute between the parties and petitioner is in custody since 11.5.2018.

No.48366 of 2018 (3) dt.03-10-2018 2/2 Having heard both sides and in the facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the 1st Additional District and Sessions Judge-cumSpecial Judge, West Champaran, Bettiah, in connection with Nautan P.S.Case No. 231 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
