ANJANA MISHRA ORAL ORDER 01-12-2015 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Hussainganj P.S. Case No.146 of 2014 for allegedly having committed the offences under Sections 366, 376, 326 and 120B/34 of the Indian Penal Code. In the present case, Petitioner No.1 is the father of accused Ravi Kumar and Petitioner No.2 is the Phua (paternal aunt of said Ravi Kumar), who are said to have brought the victim girl to Siwan Railway Station and left her there. It is submitted on behalf of the petitioners that admittedly, as per the statement of victim under Section 164 Cr.P.C., these two petitioners had no role to play in the alleged
Patna High Court Cr.Misc. No.39257 of 2014 (8) dt.01-12-2015 2/2 kidnapping of the victim girl, rather she was herself in the dark about the whereabouts of Ravi Kumar and only when they came to know that they were living in Punjab, their name came in picture.
Considering the nature of allegations made and the statement of the victim girl, let both the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan, in connection with Hussainganj P.S. Case No.146 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
