JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 04-12-2015 By order dated 16.9.2008 passed in Confiscation Case No.13 of 2007-2008, the learned Collector directed the respondent, Sub-Divisional Officer, Jhanjharpur to auction sale the seized articles in exercise of power conferred under section 6A of the Essential Commodities Act, 1955.
The contention of the petitioner is that he has challenged the aforesaid order in Cr. Appeal No.23 of 2010 and the said case is pending before the learned Additional District and Sessions Judge-II, Madhubani, since last five years.
The prayer of the petitioner in the present application is to direct the learned Additional District and Sessions Judge-II, Madhubani to dispose of the pending appeal bearing Cr.Appeal
Patna High Court Cr. WJC No.884 of 2015 (2) dt.04-12-2015 2/2 No.23 of 2010 at an early date.
Regard being had to the nature of relief prayed for in the present application, I do not feel necessity of counter affidavit in the matter.
The application is disposed of with a direction to the learned Additional District and Sessions Judge-II, Madhubani, to dispose of the Cr. Appeal No.23 of 2010 within three months from the date of receipt/production of a copy of this order. Let a copy of the order be communicated to the court below forthwith.
