Smt Renu Kumari ====================================================== CORAM: HONOURABLE MR. JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 28-09-2018 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case registered under Sections 412 and 414/34 of the Indian Penal Code. Vikram Kumar and Avinash @ Suraj Kumar were apprehended with stolen motorcycle. As per the account of the aforesaid accused persons, they had to dispose it of to the petitioner and Aditya Kumar who arrived at the place of occurrence after half an hour of their arrest to purchase the stolen motorcycle and they were apprehended.

It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. No incriminating article has been recovered from the conscious

Patna High Court Cr.Misc. No.48218 of 2018(3) dt.28-09-2018 2/2 physical possession of the petitioner. He has no concern with the aforesaid occurrence. He has been falsely implicated in the case by Bikram Kumar and Avinash @ Suraj Kumar due to animosity while he was passing through the place of occurrence at the time of occurrence. He had not gone to purchase the stolen motorcycle. The petitioner has been languishing in custody since 21.02.2018.

Learned APP for the State opposed the prayer for bail.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Vaishali at Hajipur in connection with Industrial Area P.S.
