The petitioner being the mother of the husband of the victim is apprehending her arrest in a case registered for the offences punishable under Sections 328 and 304B/34 of the Indian Penal Code.

The accusation is of killing the daughter of the informant after five years of the marriage for non-fulfillment of the dowry demand by administering poison.

It is submitted by learned counsel for the petitioner that the accusation is omnibus and general and the petitioner was not sent up for trial, but differing the final form cognizance has been taken.

No.34437 of 2015 (2) dt.14-08-2015 2/2 It is submitted by learned counsel for the informant that it is specific in the FIR that all the accused persons administered poison to the victim, but it is not in dispute that the victim was provided medical assistance. Considering the fact that accusation was not found true during investigation, let the above named petitioner be released on anticipatory bail in the event of her arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Rosera (Samastipur) in connection with Singhiya P.S. Case No. 100 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
