The petitioner seeks bail in connection with Aurai P.S. Case No.156 of 2016 registered under Section 384, 385 and 387 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is not named in the F.I.R. In course of investigation, one Jitendra Kumar was apprehended in connection with Bochahan P.S. Case No.164 of 2016 on 25.10.2016 and on search, he was found in possession of the mobile set, which was used in demanding the ransom in the present case. Thereafter, the police got recorded the confessional statement of the co-accused

Patna High Court Cr.Misc. No.16707 of 2017 (3) dt.30-06-2017 2/2 Jitendra Kumar and in his confessional statement, he disclosed the name of the petitioner as co-culprits in the present case. Except that, there is nothing against the petitioner. Besides the present case and Bochahan P.S. Case No.164 of 2016, the petitioner has no criminal antecedent. In the present case, the petitioner is in custody since 29.10.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri S.K. Tripathi, Judicial Magistrate, First Class, Muzaffarpur, in connection with Aurai P.S. Case No.156 of 2016. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner. (Rajendra Kumar Mishra, J) P.S./- U T
