JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner and others are said to have taken away the informant's brother who was subsequently found missing and after that informant lodged the present case. However, in course of investigation, the dead body of informant's brother was recovered. Submission on behalf of the petitioner is that none has seen the actual killing of the deceased. Moreover, co-accused Amardeep Badhai was seen lastly in the company of the deceased which is evident from the first information report itself. It is further submitted that co-accused Amardeep Badhai has already been granted privilege of bail by a co-ordinate Bench of this Court.
Patna High Court Cr.Misc. No.40690 of 2016 (2) dt.03-10-2016 2/2 Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Bakhtiarpur P.S.Case No. 230 of 2015.
