Learned counsel for the petitioner submits that even presuming what has been alleged is true without admitting the same then no offence under the SC/ST Act is made out and the allegation is only of threatening and no picture of the victim was made viral.

At this stage, learned counsel for the petitioner, after arguing vehemently for some time, seeks permission to withdraw the prayer for anticipatory bail.

Permission is accorded.

Accordingly, this application for grant of anticipatory bail on behalf of the petitioner is dismissed as withdrawn in connection with Gopalpur P.S. Case No. 32 of 2023 pending in the Court of learned Special Judge POCSO-cum-Additional

Patna High Court CR. MISC. No.42203 of 2023(2) dt.06-07-2023 2/2 Sessions Judge-VI, Bettiah, West Champaran/Successor Court. However, if the petitioner files an application seeking regular bail, the learned trial court shall dispose of the case on the same day if possible.
