The petitioner apprehends his arrest in connection with Complaint Case No. 206C of 2018, registered under Section 498A/34 of the Indian Penal Code, pending in the court of S.D.J.M., Nalanda at Biharsharif.

The accusation is of torturing the complainantopposite party no. 2 by her husband and in-laws due to nonfulfillment of demand of dowry and removing from her matrimonial house snatching her personal belongings. Learned counsel for the petitioner submits that while on the joint prayer of both parties, the matter was referred

No.38320 of 2019(3) dt.27-09-2019 2/2 before the Mediation and Conciliation Centre, Patna High Court, Patna but the mediation could not be succeeded due to rigid attitude of complainant-opposite party no. 2, as she expressed for one time settlement. Further submission is that complainant-opposite party no. 2 had also field maintenance case under Section 125 Cr.P.C. only to give pressure but the same has already been rejected due to non-appearance of opposite party no. 2, which clearly indicates about harassing attitude of complainant-opposite party no.2.

Having regard to the facts and circumstances of the case, the provisional pre-arrest bail granted to the petitioner vide order dated 27.06.2019 stands confirmed.
