The petitioner apprehends his arrest in connection with a case under Section 7 of the Essential Commodities Act. It is submitted that very small quantity of shortage was found with regard to wheat and rice. The petitioner had lifted 700 liters of kerosene oil and there was a shortage of 90 liters. The petitioner did not sell the same in black-market; rather some entries were left to be made in the distribution register. Only 2.5 quintal of wheat and 3 quintal of rice were found shortage. Considering the fact that a small quantity of shortage was found, the petitioner above named in the event of his arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, is

Patna High Court Cr.Misc. No.42652 of 2015 (4) dt.21-12-2015 P2/2 directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Supaul in connection with Bhimpur P.S. Case No. 04 of 2015 subject to the condition as laid down under Section 438(2) of the Cr. P.C.
