Again, I am not inclined to release the petitioner on bail on the ground mentioned by me in my previous order dated 6.11.2015 passed in Cr. Misc. no 36926/2015 and accordingly, his prayer for bail in connection with Session trial no. 179 of 2015 arising out of Kochas P.S. Case no. 100/2014 pending in the court of Addl. Sessions Judge IV, Rohtas at Sasaram stands rejected.
However, learned trial court has reported that out of ten proposed prosecution witnesses, three prosecution witnesses have already been examined and, therefore, the aforesaid fact goes to show that trial of the petitioner has already commenced. Therefore, in the aforesaid circumstance, learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible, preferably, within four months from the date of receipt/production of a copy of this order, failing which the petitioner may renew his prayer
Patna High Court Cr.Misc. No.3417 of 2017 (4) dt.17-05-2017 for bail before the trial court itself and if the petitioner does so, trial court shall pass appropriate order on merit on the petition of the petitioner without being prejudiced by this rejection order. shahid (Hemant Kumar Srivastava,J) U T
