The petitioner seeks bail in connection with Dhamadaha P.S. Case No.34 of 2016 registered under Sections 304(B)/34 of the Indian Penal Code.
The accusation is that the marriage of Sanno Khatoon, the younger sister of the informant, was performed with one Babloo Mansoori about 10 years ago and proper dowry was given at the time of her marriage. Due to their wedlock, there are five children to his sister but his sister was being tortured for the demand of dowry by her sasural people. Recently, the mother-in-law of the sister of the informant used to torture her for non fulfillment of the dowry demand and threaten her sister to perform the second marriage of her husband, namely, Babloo
Patna High Court Cr.Misc. No.23940 of 2017 (3) dt.30-06-2017 2/2 Mansoori. On 12.02.2016 at about 07.00 A.M. in the morning, the informant received information that his sister has been killed by her husband and other in-laws by pressing her neck. Learned counsel appearing on behalf of the petitioner submits that the petitioner is neither the family member nor the relative of the husband of the sister of the informant and he has been falsely implicated in this case on mere suspicion with the allegation that the husband of the deceased, the sister of the informant, wants to perform his marriage with the niece of the petitioner. The petitioner is in custody since 06.02.2016.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri L.B. Paswan, Judicial Magistrate, First Class, Purnea, in connection with Dhamadaha P.S. Case No.34 of 2016.
