ANJANA MISHRA ORAL ORDER 25-02-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 467/ 468/471/414 r/w 34 of the Indian Penal Code.

Diary in this case was called for earlier which has since been received.

Learned counsel for the petitioner submits that the vehicle in question which was recovered from his premises was not a stolen vehicle. He has purchased the same from one Nagendra who had in fact purchased it earlier by a valid document of sale from one Madhuri Devi. It is further submitted that as per Annexure-2 series at page 29 of the present application, the said document is a report from the Government of India, Ministry of

Patna High Court Cr.Misc. No.47067 of 2015 (4) dt.25-02-2016 P2/2 Home Affairs, National Crime Records Bureau, Motor Vehicle Verification, that the said vehicle i.e. Mahindra Bolero bearing Registration No. JH10AF 4217 has not been reported as stolen by the Police.

Considering the aforementioned facts and circumstances and that there is no cogent material in the case diary to implicate the petitioner in the present case, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Marhowra P.S. Case No. 131/2015 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
