The petitioner seeks bail in a case instituted under Sections 302/34 of the Indian Penal Code.

Allegation against petitioner is that she along with others has assaulted son of informant, who died in course of treatment, due to erecting electric line.

It has been submitted on behalf of petitioner that she is in custody since 14.6.2016. Chargesheet has been submitted against petitioner. He has got no criminal antecedent. No allegation of tampering of witnesses is alleged against petitioner. Petitioner is a lady. It is alleged that she caught hold of the deceased. The main allegation is against co-accused, namely, Satyendra Prasad, who assaulted upon deceased which led to his death. On behalf of the State and informant, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond

Patna High Court Cr.Misc. No.51513 of 2016 (2) dt.06-12-2016 2/2 of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned A.D.J. 7th, Nalanda at Biharsharif, in connection with S. Tr. No. 463 of 2016 arising out of Ben P.S. Case no. 63 of 2016.
