The petitioner being the husband of the informant is apprehending arrest in a case registered for the offences punishable under Sections 323, 498A, 341, 34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.

Basic accusation is of torture for non-fulfillment of dowry demand.

Learned counsel for the petitioner and the informant are present.

Learned counsel for the petitioner submits that the

Patna High Court Cr.Misc. No.34149 of 2015 (5) dt.11-04-2016 2/3 petitioner admits his marriage with the informant. Though, on joint prayer of the parties, the matter was referred to the Mediation Centre of Bihar State Legal Services Authority vide order dated 23.11.2015 but it appears from the report of the Mediator dated 07.04.2016, kept at 'flag-X' that issue has been resolved between the parties and both sides wanted to part ways on payment of one time settlement amount of Rs.2,90,000/- and return of other utensils.

Learned counsel for the petitioner submits that bank draft of rupees two lakhs ninety thousand has already been handed over to the informant as well as utensils has also been returned. Learned counsel for the informant does not dispute the contention of the counsel for the petitioner. Under the circumstances, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Rohtas at Sasaram in connection with Mahila P.S. Case No.26/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
