JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 05-12-2016 Heard the counsel for the petitioner and the State. The petitioner prays for bail in P.S. Case No. 312 of 2016 registered under section 47(A) of the Bihar Excise (Amendment) Act, 2016.
It is alleged that, on a search, two bottles of India-made foreign liquor each containing 375 ml were found kept in a plastic bag possessed by the petitioner.
It is stated that the petitioner is in custody since 12.09.2016 having no criminal antecedents.
In the facts and circumstances of the case, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of CJM, Bhagalpur in P.S. Case No. 312 of 2016
Patna High Court Cr.Misc. No.47915 of 2016 (3) dt.05-12-2016 2/2 on condition that one of the bailors of the petitioner shall be his own/close family member. In the event of framing of charge, the petitioner shall appear in person each date fixed at the trial. In case of default in doing so on two consecutive dates, the trial court shall have liberty to cancel his bail bonds and secure his arrest in accordance with law.
