2. This writ application has been filed seeking a writ in the nature of a mandamus directing the respondent no. 3 to allot 2nd counseling list of student to the petitioner institution for admission in B.Ed. Course of 2023-2025 session.

3. The grievance of the petitioner is that in the online counseling for CET-B.Ed. 2023, 138 candidates were allotted to the college and out of this, 38 candidates took admission, but in the second online counseling held on 29.05.2023, no candidate

Patna High Court CWJC No.9621 of 2023(3) dt.25-07-2023 2/3 has been allotted to the college as a result whereof 165 seats remained vacant.

4. This Court called upon the respondents to answer the grievance of the petitioner. In reply, the respondent no. 1 to 3 have submitted that on the basis of 'preference-cum-merit', students were allotted to different B.Ed. Colleges of Bihar in first round of counseling on 09.05.2023. In the first round a total number of 373 applicants expressed their preference in different order for VRTT College, Kiratpur, Vaishali which is the petitioner-college. Out of these 373 applicants only 135 applicants were selected for the said college on the 'merit-cumpreference' basis and rest were selected for other colleges. Out of these 135 applicants, only 38 applicants took admission in the said college.

It is further submitted that in the second round of counseling, no candidate remained available for the petitionercollege as such the office of the respondent no. 3 was constrained not to allow any candidate to the said college, but in the spot round counseling in which 'merit-cum-preference' does not matter, the college admitted 22 students, and hence, a total number of 60 students took admission in the session 2023-2025.

6. Having regard to the explanations furnished in the

Patna High Court CWJC No.9621 of 2023(3) dt.25-07-2023 3/3 counter affidavit, this Court is of the considered opinion that nothing remains for adjudication in the present writ application. This does not require to proceed further.
