Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 332, 337, 323, 307, 427, 504, 353 of the Indian Penal Code and 3/4 of the Prevention of Damaged to Public Property Act.

The prosecution case is that the police went to rescue the victim woman, then 80-100 villagers attacked on the police personnel, when the police personnel received injury. It is further alleged that police jeep was damaged and road was blocked.

It is submitted by the learned counsel for the petitioner that accusation is omnibus and general and for the same incident two F.I.Rs have been lodged and similarly

Patna High Court Cr.Misc. No.36565 of 2015 (2) dt.10-09-2015 situated co-accused have been granted bail vide Cr. Misc. No. 1932 of 2015.

Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Bidupur P.S. Case No. 279 of 2014, pending in the court of learned Chief Judicial Magistrate, Vaishali at Hajipur.

With the above observation this application is disposed of.
