JUSTICE RAVI RANJAN ORAL ORDER 13-07-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek bail in a case registered for offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per allegation, 60 bottles (750 ml. each) of foreign liquor has been recovered from the vehicle.

It is contended that petitioner no.1 is the driver and petitioner no.2 is the helper of the aforesaid vehicle. Petitioners claim their antecedent to be clean and they are in custody since 23.05.2017.

Considering the facts and circumstances of the case, the petitioners, above-named, are directed to be released on bail

Patna High Court Cr.Misc. No.32131 of 2017 (2) dt.13-07-2017 2 / 2 on furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of C.J.M., Banka or successor court in connection with Katoria P.S. Case No.62/2017.

Further, if the petitioners, after their release in this case, are again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of their bail bonds.
