Petitioner seeks regular bail in connection with Cheriyabariyarpur P.S. Case No.191 of 2016 registered for the alleged offences under Section 392 of the Indian Penal Code. As per the prosecution case, when the informant was coming to his house on motorcycle, four unknown miscreants snatched his motorcycle, cash of Rs.3000.00, mobile phone and also mobile phone of his companion.

It has been submitted by learned counsel for the petitioner that the petitioner is neither named in the F.I.R. nor apprehended on the spot. Nothing incriminating article has been recovered from his conscious physical possession. There is nothing on the record indicating the complicity of the petitioner in

Patna High Court Cr.Misc. No.30924 of 2017 (02) dt.06-07-2017 2/2 the case barring the confessional statement of the co-accused. He has been languishing in jail custody since 11.01.2017. In the facts and circumstances of the case, the petitioner above named is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned A.C.J.M., Manjhoul in connection with Cheriyabariyarpur P.S. Case No.191 of 2016.
