1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 118(1), 109(1), 352, 351(2) and 3(5) of the BNS, 2023.
3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is a senior citizen aged about 61 years and the informant alleges that on 03.04.2026 at 4:00 PM, seven named accused persons including the petitioner were playing PUBG on mobile phone in front of his house, further during the course of playing, the accused persons started abusing each other, thus informant asked them not to abuse since female members were in the house, on which

Shahbuddin assaulted his father by farsa causing injury on head, thereafter all the named accused persons assaulted his family members and threw bricks causing injury to his uncle on head, accordingly police was informed and the injured were taken to the hospital.

The learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant, it is next submitted that from perusal of the allegations as alleged in the FIR, it would manifest that specific allegations of assaulting the father of the informant is against Shahbuddin. It is further submitted allegation against the petitioner is general and omnibus in nature. It is fairly submitted that the injury suffered by the injured has been opined to be grievous in nature but then allegation of assault is not specifically alleged against the petitioner. It is also submitted that petitioner all throughout his life has remained a person with clean antecedent but all of a sudden has been made a criminal based on general and omnibus allegation.
5. Learned A.P.P. for the State opposes the anticipatory bail application of the petitioner.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the
Patna High Court CR. MISC. No.40513 of 2026(2) dt.02-07-2026 3/3 event of his arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Banka P.S. Case No. 184 of 2026 subject to the conditions as laid down under Section 482 (2) of BNSS.
7. The application stands allowed.
