The petitioner seeks bail in a case registered under Sections 147, 148, 149, 323, 341, 342, 427, 435, 436, 440, 504, 506, 120(B) of the Indian Penal Code and Section 3⁄4 of Explosive Substance Act and Sections 13, 16, 18, 19, 20, 38 of U.P. Act.

Prosecution case, in short, is that a big group of Naxals had attacked M.W. Sawkala Plant at Gaya and had taken the employees and guards hostage on gun point, whereafter the Porta Cabin used by the electrician was also put on fire and large scale damage was caused to the plant.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 28.03.2019. Charge sheet has

Patna High Court CR. MISC. No.38209 of 2019(2) dt.27-06-2019 2/2 been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. General and omnibus allegation has been made. No specific overt act is alleged against the petitioner. Other co-accused have been granted bail vide Annexure 2 series to the present application. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Sherghati, District Gaya in connection with Amas P.S. case No.196 of 2017.
