Petitioner is languishing in custody since 20.06.2016 in a case registered for the offences punishable under Sections 20 (b) (ii) (B), 25 of the Narcotics Drugs and Psychotropic Substances Act.

The prosecution case is that during search of the house of the petitioner 9 Kg. 800 gm. ganja was recovered kept in two yellow bags.

It is submitted by the learned counsel for the petitioner that recovery is from the joint family house of the petitioner. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent. Considering the recovery of the ganja being small and commercial quantity, this Court is not inclined

Patna High Court Cr.Misc. No.39048 of 2016 (2) dt.07-09-2016 to grant bail to the petitioner at present.

Accordingly, the bail application is dismissed.

However, the petitioner may renew his prayer for bail after remaining in custody for ten months. (Dinesh Kumar Singh, J) P.K./- U T
