The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420 and 406/34 of the Indian Penal Code.
The prosecution case is that the informant for purchasing land gave Rs.3,03,000/- to the accused persons including the petitioner when the sale deed was registered but at the time of registration the land owners Ram Pravesh Chauhan and Ram Suresh Chauhan failed to turn up as a result the sale deed could not be registered.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.35542 of 2015 (2) dt.03-09-2015 2/2 petitioner that from the FIR it transpired that no payment was made to this petitioner. The petitioner is not the land holder and it appears that the vendors were Ram Pravesh Chauhan and Ram Suresh Chauhan, who failed to turn up at the time of registration of sale deed.
Considering the fact that the thrust of accusation is against Ram Pravesh Chauhan and Ram Suresh Chauhan, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar (Industrial Area) P.S. Case No. 175 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) DKS/- U T
