2. The petitioner seeks bail in connection with Dariyapur P.S. Case No. 298 of 2020 registered for the offence under Section 272, 273, 120(B) of the IPC and Sections 30(a), 42(i) of the Bihar Prohibition and Excise Act, 2018.

4. Recovery is of 4800 litres of illicit liquor from the possession of the petitioner which was kept in the garden.

5. Learned counsel for the petitioner submits that the name of the petitioner has come on the basis of confessional statement of co-accused. He further submits that the petitioner has got clean antecedent and he is in custody since 04.05.2024.

6. Considering the period of custody and the recovery of liquor, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court, Chapra at Saran in connection with Dariyapur P.S. Case No. 298 of 2020.

8. This is also subject to the condition that the petitioners will also deposit an amount of Rs. 50,000/- (Rupees Fifty Thousand Only) in Ramkrishna Mission Ashrama, Latu Maharaj Path, Opposite Circuit House, Chapra, Bihar 841301 and produce the receipt of the same before the Court below. The bail bonds of the petitioner shall be accepted after verifying the genuineness of the receipt produced by the petitioners.

9. The petitioner will visit Dariyapur Police Station on the first & third Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
