JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-09-2019 This application, for grant of anticipatory bail, arises out of Paroo P.S. Case No. 122/2018, disclosing offences under Section 498(A), 341, 323, 325, 307 and 34 of the Indian Penal Code and Sections.

Petitioner happens to be husband of the informant and allegation against him is of subjecting the informant to cruelty in connection with demand of dowry of Rs. One lac and further allegation is that he threaten to remarry with another lady and he has also brought one lady from Assam and told the informant that she is his wife and when she protested, the petitioner started torturing her. Submission of learned counsel for the petitioner is that all the allegations are false and concocted and in fact the informant is residing in the house of the petitioner and she is ill behaved lady due

Patna High Court CR. MISC. No.37752 of 2019(5) dt.19-09-2019 2/2 to which, the petitioner has kept his mother at his sisters house at Muzaffarpur and he is also residing there. However, in spite of that he is ready to keep the informant with full honour and dignity, Heard learned A.P.P. as well as learned counsel for the informant. Learned counsel for the informant has submitted that the informant is also ready to live with the petitioner, if she is kept with full honour and dignity as a wife.

Having heard both sides, considering the facts and circumstances of the case, this application is disposed of with direction to the petitioner and the informant to appear before the concerned court below on 14.10.2019 and if the petitioner files an affidavit that he will not torture the informant and will keep her with full honour and dignity and further he is ready to pay the expenses to the informant, the court below shall release the petitioner on bail on furnishing bail bonds of Rs. 25,000/- (Rs. Twenty Five Thousand) each to the satisfaction of concerned court below in connection with Paroo P.S. Case No. 122/2018.
