The petitioner seeks bail in Nabinagar P. S. Case No. 101 of 2019 instituted for the offence under Section(s) 341, 323, 354B, 379 and 34 of the Indian Penal Code and Section 8 of POCSO Act.

Learned counsel for petitioner submits that instant case has been filed as a counter blast to Nabinagar P.S. case no. 7 of 2019 filed against informant by petitioner on 14.3.2019. It is alleged in the instant case that on the date of occurrence co- accused Pawan Kumar caught the hand of the informant and tried to outrage her modesty. The informant started crying then this petitioner started assaulting and caused

Patna High Court CR. MISC. No.38634 of 2019(2) dt.28-06-2019 2/2 teeth bite on her left thigh. The injury report of the informant has been annexed as Annexure-3 which shows that simple injury has been caused on the person of the informant. Petitioner is in custody since 11.4..2019 having no criminal antecedent.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the 1st Addl. Sessions Judge-cum Special Judge POCSO Act, Aurangabad, in connection with Nabinagar P. S. Case No. 101 of 2019 subject to the condition that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) shyambihari/- U T
