JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 363,366A and 120B/34 of the Indian Penal Code.

The accusation is of abducting the minor daughter of the informant by Ram Prit Bhagat. It is alleged that co accused Ram Prit Bhagat, Gauri Shankar Paswan, Sunil Pandit, Arjun Pandit and the petitioner facilitated the kidnapping. It is submitted by the learned counsel for the petitioner that the thrust of accusation is against Ram Prit Bhagat and the fact that Ram prit kidnapped the daughter of the informant was disclosed by co accused Arjun Pandit whose auto rickshaw was used and he talked with Ramprit on mobile. It is further submitted

Patna High Court Cr.Misc. No.36301 of 2015 (2) dt.08-09-2015 2/2 that co accused Arjun Pandit and Sunil Pandit have been granted bail vide Cr. Misc. Nos. 42522 of 2014 and 7906 of 2015. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the thrust of accusation against co accused Ramprit Bhagat, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Vaishali at Hajipur in connection with Mahua P.S. Case No.306 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
