Petitioner seeks bail in Raxaul P.S. Case No.67 of 2019 instituted for the offence under Section(s) 25(1-B)A/26 of the Arms Act.

Counsel for the petitioner submits that alleged firearm was produced by the SSB Officials before the police. From the seizure list, it is apparent that there is no recovery of firearm from conscious possession of the petitioner. Same was produced by SSB Officials before the police.

It is alleged that SSB Officials recovered one semi automatic pistol and four live cartridges from possession of the petitioner.

Petitioner is in custody since 07.03.2019 having clean

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the SDJM, Raxaul at Motihari, in connection with Raxaul P.S. Case No.67 of 2019, subject to the condition that both the bailors shall be close relative of the petitioner.
