JUSTICE SUDHIR SINGH ORAL ORDER 03-08-2017 The petitioner in the present writ application has sought for direction upon the University to call for the meeting of University Selection Committee/Promotion Committee and to place the papers of the petitioner before the Selection Committee for consideration for promotion of the petitioner to the post of Reader.
It has been pointed out in para-2 of the second counter affidavit, filed on behalf of the University, that the promotion under 10 years time bound promotion scheme will be placed before the Promotion Committee, in the next meeting. It is submitted on behalf of the petitioner that every month, the meeting of the Selection Committee takes place, hence,
Patna High Court CWJC No.17679 of 2010 (10) dt.03-08-2017 2/2 the case of the petitioner be considered within a period of three months and in pursuance of the same, the order be passed within a period of one month. So, the benefit of the promotion can be availed by the petitioner.
Considering the submissions made on behalf of the parties, the respondent no.3 i.e. The Registrar, T.M. Bhagalpur University, Bhagalpur is directed to ensure that the case of the petitioner is placed before the Selection Committee within a period of three months from the date of production of copy of this order and if the decision of the Selection Committee be in favour of the petitioner then it must be complied within a period of one month from the date of decision of the Selection Committee. With the aforesaid observation and direction, the present application stands disposed of.
