JUSTICE ARUN KUMAR ORAL ORDER 21-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered under Sections 414/120(B) of the Indian Penal Code. The allegation is that the police in the after noon apprehended three persons going on a motorcycle. On demand no paper was produced by them. The motorcycle was a stolen motor cycle and some Ganja was also recovered from a bag for which a separate case was lodged under NDPS Act.

Learned counsel appearing on behalf of the petitioner submits that the petitioner has got clean antecedent. NDPS Act case was lodged against him and that case relates to recovery of 400 gm Ganja in which he has been granted bail. The petitioner is in custody since 28.07.2016.

No.54168 of 2016 (2) dt.21-12-2016 2/2 Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.,Buxar, in connection with Buxar (T) P.S.Case No.313 of 2016.
