JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-07-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is in jail custody since 26.05.2014 in connection with S.T. No. 194 of 2016 arising out of Barauni (Chakiya) P.S. Case No. 247 of 2014 pending in the court of learned 2nd Addl. Session Judge, Begusarai and earlier his prayer for bail was rejected several times and while rejecting his prayer for bail on 16.03.2016 in Criminal Miscellaneous No. 51583 of 2015, this Court directed the trial court to conclude the trial of the petitioner within six months from the date of framing of charge. More over the impugned order dated 09.05.2016 goes to show that except I.O. and doctor, almost all the prosecution witnesses have already been examined meaning thereby, the trial of the petition is

Patna High Court Cr.Misc. No.32450 of 2017 (2) dt.19-07-2017 2/2 still pending.

Since all the private witnesses have already been examined, therefore, there is no apprehension of tampering with the prosecution evidence at the hands of the petitioner, accordingly, petitioner is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Addl. Sessions Judge, Begusarai in connection with Barauni (Chakiya) P.S. Case No. 247 of 2016.
