JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420/406 of the Indian Penal Code.

It is alleged that the petitioner took Rs.3,70,000/- as loan for opening a mobile shop acknowledged the same on a stamp paper, but on demand the petitioner refused to return the amount.

It is submitted by learned counsel for the petitioner that in fact the informant has taken loan from the petitioner and the said transaction has also been acknowledged on stamp paper. It is further submitted that in the background of contractual nature of

Patna High Court Cr.Misc. No.35199 of 2015 (3) dt.09-09-2015 2/2 dispute between the parties, the accusation has been levelled. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the nature of accusation, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, West Champaran at Bettiah in connection with Bettiah Town P.S. Case No.81 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
