Learned counsel for the petitioner undertakes to remove the defects within four weeks of resumption of normal court proceeding. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.
The petitioner seeks bail in a case registered for the offence punishable under Section 25 (1-b)a/26 of the Arms Act. While the informant was on patrolling duty along with police force, he saw a person coming on motorcycle. On suspicion, the police party stopped the said person who tried to fled away but was apprehended. On search one loaded country made pistol and one live cartridge was recovered from his possession.
Patna High Court CR. MISC. No.38057 of 2020(2) dt.05-02-2021 2/2 It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He is quite innocent and has been falsely implicated in this case by the police. No incriminating article has been recovered from his conscious physical possession rather the police has forcefully taken the signature of the petitioner on the seizure list. Moreover, there is no independent seizure list witness. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. The petitioner has been languishing in custody since 18.12.2019.
Learned APP for the State opposed the bail petition.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1stClass, Jamui in connection with Laxmipur (Jamui) P.S. Case No.465 of 2019.
