The petitioner is apprehending arrest in a case registered for the offences punishable under section 3(a) of the Railway Property (Unlawful Possession) Act.

On recovery of some stolen railway articles from the scrap shop of the petitioner the FIR was registered. It is submitted by the learned counsel for the petitioner that only on suspicion the recovery has been shown and there is no actual recovery of any stolen railway property from the scrap shop of the petitioner. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent

Patna High Court Cr.Misc. No.33269 of 2015 (2) dt.26-08-2015 2/2 The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with RPP/Post/Barsoi Case No. 1(6)/15 pending in the court of learned Railway Judicial Magistrate, Katihar.

This application is disposed of with the aforesaid observation/direction.
