The petitioner is in custody in a case registered under Sections 147,148,149 and 302 of the Indian Penal Code and 27 of Arms Act.

It is alleged by the informant that on 21.1.2016 at about 12.05 P.M. he along with Amerika Yadav had gone to Karjani Bhuitoli for making payment to labourers. When they were coming back to home at about 12.35 P.M. on the way informant stopped for discharging urine at 1.50 P.M. all the accused persons named in the FIR including the petitioner armed with pistol and rifle fired at Amerika Yadav, causing injury above right chest and on hip due to that injuries he died at Chandandih Bhindas road near Karjani Bhuitoli.

No.26293 of 2016 (3) dt.23-08-2016 2/2 It is submitted on behalf of the petitioner that the petitioner is in custody since 08.04. 2016.The petitioner has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering with the evidence against the petitioner. General and omnibus allegation of firing has been made against all 14 accused persons. Only two fire arm injuries are found on the body of the deceased. Lacerated wound and abrasion injuries (A and B) to the post mortem report on the body of the deceased have not been explained by the prosecution. On behalf of the State and the informant it is submitted that the petitioner is named in the FIR.

Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gaya in connection with Atri P.S.Case No. 14 of 2016.
