Learned counsel for the petitioner is permitted to remove the defects as pointed out by the office. The petitioner is an accused in a case registered for the offence punishable under Section 304-B/34 of the Indian Penal Code. Evidence has come during investigation to connect her with the crime. Her prayer for grant of anticipatory bail was rejected by this Court on 22.12.2021. Thereafter, the petitioner did not surrender and participate in the trial. Subsequently, the trial of the son of the petitioner has been concluded and he has been acquitted.
It has been submitted by learned counsel for the petitioner that since her son has been acquitted, she is entitled to grant of anticipatory bail.
Patna High Court CR. MISC. No.45513 of 2023(2) dt.19-07-2023 2/2 Absconders cannot be granted anticipatory bail by this Court. Moreover, evidence of another trial cannot be looked into in the present case.
In view of the above, this application is dismissed. The petitioner is directed to surrender with four weeks from today.
If the petitioner does not surrender within four weeks, the Superintendent of Police, Saran will take all coercive steps for arrest of the petitioner.
Let a copy of the order be communicated to the Superintendent of Police, Saran at Chapra for its compliance through FAX and e-mail forthwith.
