The petitioners seek bail in connection with Nautan P.S. Case No. 40 of 2017, registered under Section 272, 273 and 308/34 of the Indian Penal Code and Section 30 and 38 of the Bihar Excise (Amendment) Act, 2016.

The accusation is of recovery of 48 bottle, each containing 180 ML, India made foreign liquor and 135 bottle, each containing 200 ML country made liquor kept in a plastic bag to the motorcycle on which both the petitioners were found sitting.

Learned counsel for the petitioners submits that petitioners having no criminal antecedent are in custody since

Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the ACJM-XII, Siwan in connection with Nautan P.S. Case No. 40 of 2017.
