Petitioner in the present case has questioned the order of suspension as contained in Memo No. 3105 dated 13.07.2016.

This Court has been informed that by the impugned order, a disciplinary proceeding was initiated against the petitioner and during pendency of the writ application, the said disciplinary proceeding has already been concluded wherein the

Patna High Court CWJC No.15800 of 2021(2) dt.11-05-2023 2/2 petitioner has been served with a punishment of dismissal from service.

It is stated that the order of dismissal has been separately challenged in CWJC No. 15706 of 2021 which is pending before this Court.

Learned counsel for the State submits that in such circumstance, this application has become infructuous. Having regard to the facts and circumstances of the case, this writ application is being disposed of as having become infructuous, however, all the contentions raised in this writ application are left open to be taken in course of hearing of CWJC No. 15706 of 2021.
