2. Petitioners seek bail who is in custody since 16.01.2026 in connection with Raxaul P.S. Case No. 522 of

2/4 2025, F.I.R. dated 07.12.2025 for the offences punishable under Section 303(2) of the Bharatiya Nyay Sanhita, 2023.

3. According to prosecution case, the informant alleged that some unknown miscreants stole his bike bearing registration no.BR05T7469 when he parked it in front of the main gate of Dr. Shaista Pravin's clinic.

4. Learned counsel for the petitioners submits that petitioners are innocent and they falsely been implicated in the present case. Petitioners are not named in the FIR and their name have been transpired in this case merely on the basis of confessional statement of co-accused persons, namely, Bablu Kumar and Sonu Singh and except the disclosure made by apprehended co-accused persons, no other cogent material has come during investigation which suggest the involvement of the petitioners in the present occurrence. He next submits that and similarly situated co-accused person, namely, Munna Kumar has been granted the privilege of bail by this Court vide order dated 14.05.2026 in Cr. Misc. No. 33542 of 2026. The police after investigation submitted charge-sheet against the petitioners and the petitioners are in custody since 16.01.2026.

5. The learned Additional Public Prosecutor for the State has vehemently opposed the prayer for bail of the

3/4 petitioners and submits that petitioner, namely, Jahir Alam has got three criminal antecedents in which he is on bail in one case and petitioner, namely, Sanu Kumar @ Sanu Kumar Singh has got three criminal antecedents other than the present one.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Division Judicial Magistrate, Raxaul, Motihari, East Champaran in connection with Raxaul P.S. Case No. 522 of 2025, subject to the following conditions:- i. Petitioners shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the court and on their absence on two consecutive dates without sufficient reason, their bail bond shall be cancelled by the Court below. ii. If the petitioners tamper with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.

iii. And further condition that the court below shall verify the criminal antecedent of the petitioners and in case at any stage it is found that the petitioners have concealed their

4/4 criminal antecedents, the court below shall take step for cancellation of bail bond of the petitioners. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
